Welcome to Carnage UK. The following are the rules or "Terms" that govern use of the Carnage UK website ("Site"). By using or visiting the Site, you expressly agree to be bound by these Terms and to follow these Terms and all applicable laws and regulations governing the Site. Carnage UK reserve the right to change these Terms at any time, effective immediately upon posting on the Site. Please check this page of the Site periodically. If you violate these Terms of Use, Carnage UK may terminate your use of the Site, bar you from future use of the Site, cancel your t-shirt order, and/or take appropriate legal action against you.

Carnage UK is a trading name of Varsity Leisure Group. Varsity Leisure Group is a registered and trading business within the United Kingdom, registered Company No. 6304471, registered as a private limited company on 6th July 2007.

Permitted Use

You agree that you are only authorised to visit, view and to retain a copy of pages of this Site for your own personal use, and that you shall not duplicate, download, publish, modify or otherwise distribute the material on this Site for any purpose other than to review event and promotional information, for personal use, or to purchase t-shirt/t-shirts or merchandise for your personal use, unless otherwise specifically authorised by Carnage UK to do so. You also agree not to deep-link to the site for any purpose, unless specifically authorised by Carnage UK to do so. The content and software on this Site is the property of Carnage UK and/or its suppliers. We post a legal notice and various credits on pages of the Site, which may not be removed. Please do not remove this notice or these credits, or any additional information contained along with the notices and credits.

Disclaimers

Carnage UK does not promise that the Site will be error-free, uninterrupted, nor that it will provide specific results from use of the Site or any Content, search or link on it. The Site and its Content are delivered on an "as-is" and "as-available" basis. Carnage UK cannot ensure that files you download from the Site will be free of viruses or contamination or destructive features. Carnage UK disclaims all warranties, express or implied, including also any implied warranties of merchantability and fitness for a particular purpose. Carnage UK is not responsible for the products, services, actions or failure to act of any venue, performer, promoter or other third party in connection with or referenced on the Site. Without limiting the foregoing, you may report the misconduct of users and/or third party advertisers, service and/or product providers referenced on or included in the Site to Carnage UK at legal@carnageuk.com. Carnage UK may investigate the claim and take appropriate action, in its sole discretion.

The Site may automatically produce search results that reference or link to third party sites throughout the World Wide Web. Carnage UK has no control over these sites or the content within them. Carnage UK cannot guarantee, represent or warrant that the content contained in the sites is accurate, legal and/or inoffensive. Carnage UK does not endorse the content of any third party site, nor do we warrant that they will not contain viruses or otherwise impact your computer. By using the Site to search for or link to another site, you agree and understand that you may not make any claim against Carnage UK for any damages or losses, whatsoever, resulting from your use of the Site to obtain search results or to link to another site. If you have a problem with a link from the Site, please notify us at legal@carnageuk.com  and we will investigate your claim and take any actions we deem appropriate in our sole discretion. Please note this address does not handle enquiries concerning current or past orders/transactions/purchases.

Please include your invoice reference number and the first name, surname and postcode the booking is under. Failure to provide us with this information will result in delays responding to your query. Prohibited Content

The following is a partial list of the kind of Content which is illegal or prohibited on the Site. It includes Content that:

  • is patently offensive to the online community, such as Content that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual; could be harmful to minors;
  • harasses or advocates harassment of another person;
  • involves the transmission of "junk mail", "chain letters", or unsolicited mass mailing or "spamming";
  • promotes information that you know is false, misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libellous;
  • promotes an illegal or unauthorised copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;
  • contains restricted or password only access pages, or hidden pages or images (those not linked to or from another accessible page);
  • displays pornographic or sexually explicit material of any kind;
  • provides material that exploits people under the age of 18 in a sexual or violent manner, or solicits personal information from anyone under 18;
  • provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
  • solicits passwords or personal identifying information for commercial or unlawful purposes from other users; and
  • engages in commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, and pyramid schemes.

 

Offline Conduct

Although Carnage UK cannot monitor the conduct of its Users off the Site, it is also a violation of these rules to use any information obtained from this Site in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit or sell to any User without their prior explicit consent.

No Commercial Use

No area of this Site may be used by our visitors for any commercial purposes such as to conduct sales of t-shirts, merchandise or services of any kind. You must obtain our prior written consent to make commercial offers of any kind, whether by advertising, solicitations, links, or any other form of communication. We will investigate and take appropriate legal action against anyone who violates this provision, including without limitation, removing the offending communication from the Site and barring such violators from use of the Site. We reserve the right to block access to or cancel a t-shirt order/s on any user known or reasonably believed to be associated with any t-shirt broker or tout, or utilising automated means to process or place t-shirt orders, or re-selling t-shirts for commercial gain in any manner whatsoever.

Access and Interference

You agree that you will not use any robot, spider, other automatic device, or manual process to monitor or copy our web pages or the content contained thereon or for any other unauthorised purpose without our prior express written permission. You agree that you will not use any device, software or routine to interfere or attempt to interfere with the proper working of the Carnage UK website. You agree that you will not take any action that imposes an unreasonable or disproportionately large load on our infrastructure. You agree that you will not copy, reproduce, alter, modify, create derivative works, or publicly display any content (except for your own personal, non-commercial use) from our website without the prior express written permission of Carnage UK.

Unauthorised Use of the Site

Illegal and/or unauthorised uses of the Site, including, but not limited to, unauthorised t-shirt sales, unauthorised framing of or linking to the Site, or unauthorised use of any robot, spider or other automated device on the site, will be investigated and appropriate legal action will be taken, including without limitation civil, criminal and injunctive redress. Any unauthorised use of Site will result in legal action being taken.

Violation of the Terms

You understand and agree that in Carnage UK’s sole discretion, and without prior notice, Carnage UK may terminate your access to the Site, cancel your t-shirt order or exercise any other remedy available and remove any unauthorised User Content, if Carnage UK believes that the User Content you provided has violated or is inconsistent with these Terms of Use, violated the rights of Carnage UK, another User or the law. You agree that monetary damages may not provide a sufficient remedy to Carnage UK for violations of these terms and conditions and you consent to injunctive or other equitable relief for such violations. Carnage UK may release user information about you if required by law, or if the information is necessary or appropriate to release to address an unlawful or harmful activity. Carnage UK is not required to provide any refund to you if you are terminated as a User because you have violated these Terms of Use.

Limitation on Liability

In no event will Carnage UK be liable to you for any indirect, consequential, exemplary, incidental, special or punitive damages, including also lost profits, even if Carnage UK has been advised of the possibility of such damages.

Disputes

This Site is controlled and operated by Carnage UK from its offices in the United Kingdom. The Site is reomtely monitored and managed 24 hours a day, 365 days a year.

If there is any dispute about or involving the Site, by using the Site, you agree that the dispute will be governed and construed by English law. In the event of a dispute arising out of or relating to these terms and conditions, or your use of or access to this site, litigation must be brought in court in London, England without regard to its conflict of law provisions.

Indemnity

You agree to indemnify and hold Carnage UK, its subsidiaries, affiliates, officers, agents and other partners and employees, harmless from any loss, liability, claim or demand, including reasonable legal and litigation fees, made by any third party due to or arising out of your use of the Site, including also your use of the Site to provide a link to another site or to upload content or other information to the Site.

CARNAGE UK PURCHASE POLICY

Our goal at Carnage UK is to make your purchasing experience easy, efficient and equitable, so we can get you on your way to events as quickly as possible. The following purchase policies are designed to ensure your satisfaction and understanding of the purchase process on www.carnageuk.com. This Purchase Policy incorporates our Terms of Use by this reference.

Purchase Policy

Carnage UK sells t-shirts for Carnage UK fancy dress student events in the UK. Carnage UK does NOT issue exchanges or refunds after a purchase has been made or for lost, stolen, damaged or destroyed t-shirts. When you receive your t-shirt/t-shirts, please keep them in a safe place.T-shirts purchased on www.carnageuk.com may be subject to a per t-shirt convenience charge and a non-refundable per order handling charge. When purchasing t-shirts on www.carnageuk.com, you may be limited to a specified number of t-shirts for each event. If this applies to the event for which you are ordering t-shirts, this amount is included on the first purchase page and is verified with every transaction. This policy is in effect to discourage unfair t-shirt buying practices.

Despatch/Delivery Policy & Returns Policy

Carnage UK will despatch your t-shirts to a central collection point in the city where your event is taking place. The central collection point will always be one of our participating venues for the event.

The t-shirts will ONLY be available to collect from the central collection point on the day of the event. The t-shirts will ONLY be available to collect, in person, by the person who has completed the on-line transaction. The collection times in ALL cities is between13:00 and 17:00 on the actual day of the event. Any orders that have NOT been collected will either be destroyed or sold to other students AFTER 17:00. It is your responsibility at the time of placing your order to ensure that you are available between 13:00 & 17:00 on the day of your event to go to the central collection point to collect your order.

When you come to collect your order from the central collection point, you MUST bring with you your invoice for the order which you are collecting. You must also bring 2 forms of identification to verify your identity. This MUST be a UK Passport/Country of Origin Passport and/or a driver’s licence photocard. You MUST also bring 1 other form of identification. This can be a credit and/or debit card, utility bill (NOT a mobile telephone bill), bank statement. All identification produced MUST be the originals. Photocopies will NOT be accepted.

Only the person who has placed the order and payed for the tranasction is permitted to come to the collection point to collect the order. We will NOT issue your order to a friend, housemate, colleague in your absence. You MUST appear in person to collect your order from the central collection point; we will NOT sign your order over to any third parties.

You are able to login to your personal account on our website. Here, you will be able to see all current orders and all previous orders which you have made with Carnage UK. Details of the central collection point location for your city/event will also be displayed via your personal account administration area.

You are also able to view details of the central collection point for your city/event on our website.

T-shirts are sold solely online. All of our events are EXTREMELY popular and consequently may sell out very quickly. Occasionally, additional t-shirts may become available prior to the event, however Carnage UK does NOT guarantee such availability.

We do NOT offer a returns policy under ANY circumstances for ANY t-shirts ordered on our website.

T-shirt Terms and Conditions

  1. Carnage UK sells Carnage UK event t-shirts via the Site, as a method of granting permission to attend a specific UK event, in a specific pre-designated city, taking place on a specific pre-designated day, date, month and year. At all times, this t-shirt remains the property of Carnage UK and is a personal revocable license which may be withdrawn and admission refused at any time.
  2. The purchaser represents and warrants that the t-shirt is purchased for personal use only, and that it is not purchased as part of any form of business or commercial activity, and in particular, that the t-shirt may not be resold or offered for resale by anyone whether at a premium or otherwise and may not be used for advertising, promotion (including contests and sweepstakes) or for any other trade purposes including, for the avoidance of doubt, any publication via the internet or any other means. Resale or attempted resale of a t-shirt, or any other breach of this term, is grounds for seizure or cancellation of that t-shirt without refund or other compensation. Carnage UK may chose to enforce these terms in accordance with the provisions of the Contracts (Rights of Third Parties) Act 1999 (the Act). Except as provided above, this agreement does not create any right enforceable by any person who is not a party to it under the Act, but does not affect any right or remedy that a third party has which exists or is available apart from that Act. It is your responsibility to check your t-shirts; mistakes cannot be rectified and refunds will NOT be made under any circumstances.
  3. You MUST be over the age of 18 to attend ANY event advertised on our Site. We operate the pro-active Challenge 21 policy at all participating venues within the UK, at all events and in all cities. If you appear to be under the age of 21, you will be asked for identification to prove that you are over the age of 18. You MUST ensure that you bring the correct proof of age identification with you to each event and present the identification at each venue, upon request.
  4. You will be asked for proof of age identification at any or all of our participating venues. We will ONLY accept a driver’s licence photocard and/or a UK Passport or Country of Origin passport for the purpose of proving that you are over the age of 18 years. No proof of age identification will result in entry to any and/or all of our participating venues being refused. Refunds will NOT be possible under any circumstances.
  5. We do NOT accept any student/NUS cards as proof of age identification. Incorrect forms of identification will result in entry to any and/or all of our participating venues being refused. Refunds will NOT be possible under any circumstances.
  6. At certain venues, you may be asked to produce your NUS/Student Card to prove your student status. You MUST ensure that you bring your NUS/Student Card identification with you to each event and present the identification at each venue, upon request. If you fail to provide this, any of our participating venues have the right to refuse you entry to any venue and/or all venues. Refunds will NOT be possible under any circumstances.
  7. The t-shirt/t-shirts which you purchase for any Carnage UK event is/are ONLY valid in the city and for the city event specified/printed on the front and reverse of the t-shirt/t-shirts. T-shirts are NOT transferable between events in other cities, other than the city specified and printed on the front and reverse of the t-shirt/t-shirts which you have purchased.
  8. Any t-shirt/t-shirts which you purchase for any Carnage UK event is/are ONLY valid on the date specified and printed on the front and reverse of the t-shirt/t-shirts which you have purchased and any t-shirt/t-shirts is/are subject to clause 7 above. The validity of the t-shirt expires at 03:00 on the following day of the date specified and printed on the front & reverse of the t-shirt/t-shirts.
  9. It is the t-shirt holder’s responsibility to ascertain whether an event has been cancelled and the date and time of any rearranged event. If an event is cancelled or rescheduled, we will use reasonable endeavours to notify t-shirt holders of the cancellation as soon as is possible. We do not guarantee that t-shirt holders will be informed of such cancellation before the date of the event.
  10. Unless indicated otherwise in relation to a particular event, if an event is cancelled, t-shirt holders will be informed of the rescheduled event. If the t-shirt holder is unable to attend the rescheduled event or the event is not rescheduled, a refund will be given. Refunds for t-shirts purchased prior to the date of the original event will be given up to the face value of the t-shirt purchased plus the relevant per ticket booking fee. In order to claim your refund, please email voidevent@carnageuk.com regarding your purchase. This does not affect your statutory rights.Tickets cannot be exchanged or refunded after purchase.
  11. This t-shirt is issued subject to the Rules and Regulations of the participating venues on the event. Breach of any of these Rules and Regulations or any unacceptable behaviour likely to cause damage, nuisance or injury shall entitle any participating venue or a member of the Carnage UK management team to eject you from any participating venue and/or remove you from the event. This is in the interest of public safety.
  12. All participating venues and Carnage UK management reserve the right to refuse admission should patrons breach any Rules and Regulations of the participating venues. The participating venues may have to conduct security searches to ensure the safety of all patrons.
  13. From time to time, we may need to alter the participating venues, change participating venues and/or exclude participating venues. Whilst this is extremely rare, this situation or a combination of all situations could occur. Carnage UK reserve the right to alter, amend and/or vary the scheduled progamme. This is without obligation to refund t-shirts in part and/or in full.
  14. The end venue/destination club may have in place a policy to cease admissions to their venue after a certain time. It is your responsibility to ensure that you arrive at the end venue/destination club before this time to ensure entry. Refunds will NOT be made for non-entry into end venue/destination club.
  15. We will NOT be responsible for any t-shirts that are lost or stolen. We are unable to accept any liability or replace any t-shirts lost, stolen or damaged after they have been received by you.
  16. T-shirts are NOT refundable under any cicumstances other than cancellation of the whole event.
  17. T-shirts are sold subject to the participating venues and/or Carnage UK’s right to alter or vary the event due to events or circumstances beyond its reasonable control without being obliged to refund monies.
  18. Participating venues and Carnage UK accept no responsibility for any personal property. This includes any property deposited in any cloak rooms, at any of our participating venues.
  19. There will be no pass-outs, walk-overs or re-admissions of any kind.
  20. T-shirt holders consent to filming and sound recording as participants of the event.
  21. T-shirt holders consent to being photographed as participants of the event. The use of any photographs taken will be solely used for the purposes of our marketing operations, to include, flyers, posters, banners and any form of digital marketing practices operated by Carnage UK.
  22. T-shirts may be restricted to a maximum number per person, per credit card and, for some events, a restriction may apply per household/address. We reserve the right to cancel t-shirt orders without prior notice purchased in excess of this number.
  23. Neither the participating venues nor Carnage UK shall have any further liability beyond the face value of the t-shirt purchased plus any relevant t-shirt booking fee that may apply.
  24. All of these terms and conditions are governed by English Law and any disputes arising out of any transaction with Carnage UK are subject to the exclusive jurisdiction of the English courts.

CARNAGE UK PRIVACY POLICY

Carnage UK has created this privacy statement in order to demonstrate our firm commitment to the privacy of the details that you provide us when using this web site ("Site"). When you use the Site, you are consenting to the practices set forth in this Privacy Policy.

Your IP Address

We use your IP address to help diagnose problems with our server and to administer the Site. Your IP address is also used to help identify you and to gather broad demographic information about you. Your IP address may also be used to assist in the detection of fraud and we may pass this information to the police.

Our Site's registration forms, order forms, surveys, competitions and prize draws require you to give us personal information (like your name, address and/or email address). If you are ordering tickets, you will be asked to provide financial information (like your account or credit card numbers).

How We Use Personal Information

Carnage UK

Carnage UK sells t-shirts for Carnage UK fancy dress student events. Your personal information is shared between Carnage UK and its Event Partner for the particular event for which you are buying t-shirts in accordance with this Privacy Policy. Your personal information is used by us to contact you by phone or by email when necessary in connection with transactions entered into by you on the Site.

If you sign up as a member of our Site, you will be notified of upcoming events and offers put forward by Carnage UK. This notification will be electronic, either by SMS or email, or both. You are given the opportunity to unsubscribe to this service unsubscribing via the links provided at the footer of our electronic communication.

From time to time, Carnage UK may contact you by email, with information or offers regarding upcoming events, products, services or customer surveys. If you do not wish to be contacted by Carnage UK about upcoming events, products, services or surveys please use the unsubscribe facility which is displayed at the footer of any of our electronic marketing material.

Carefully Selected Third Parties

Depending on your selection when you purchase a t-shirt or create an account, your personal information may also be provided to carefully selected third parties that may contact you by post or email with information or offers regarding their goods and services.

Opting Out

You may opt out of any of Carnage UK’s regular email contact at any time even if you have previously indicated your consent to such contact at some other time by using the unsubscribe facility on the footer of any of our electronic marketing material.

How We Use Financial Information

Financial information that is collected is used to authorise payment and bill you for products and services. When you make a purchase on the Site, your consent is given to provide your financial or personal information to those third parties necessary to process your transactions with us, such as credit card companies and banks.
